Welcome to Unsorted

These Terms and Conditions ("Terms") govern your use of Unsorted - Visual To Do List (the "App"), developed by Miguel Angel Banda Rodriguez, doing business as Studio Ascensus ("we," "us," or "our").

By downloading, installing, or using Unsorted, you agree to these Terms. If you don't agree, please don't use the App.

1. The App

Unsorted - Visual To Do List is a task management application for iOS devices. The App allows you to:

• Create visual tasks represented as growing bubbles
• Organize tasks into color-coded categories
• Store your tasks locally on your device using Core Data
• Manage your to-do list without due dates, tracking, or ads

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Unsorted on iOS devices that you own or control, solely for your personal, non-commercial use.

What You Can Do:

• Use Unsorted for personal task management
• Install Unsorted on multiple devices linked to your Apple ID (subject to Apple's Family Sharing policies)
• Store your tasks locally on each device

What You Cannot Do:

• Sell, rent, lease, or sublicense the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Modify, adapt, translate, or create derivative works of the App
• Use the App for commercial purposes without our written permission
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use automated systems (bots, scrapers) to access the App
• Attempt to circumvent any technical limitations or security measures

3. Pricing and Payment

Free Version

Unsorted is free to download and includes a limited number of tasks. This allows you to try the App before making a purchase.

Full Version Unlock

To unlock unlimited tasks, you can make a one-time in-app purchase of $14.99 USD (or equivalent in your local currency).

• This is a one-time payment, not a subscription
• Once purchased, you have lifetime access to the full version
• Pricing may vary by region based on Apple's pricing tiers
• All payments are processed by Apple through the App Store

No Refunds

All purchases are final and non-refundable, in accordance with Apple's standard App Store refund policy. However, you may contact Apple directly if you believe you're entitled to a refund under applicable consumer protection laws.

4. Local Data Storage

Unsorted stores your data locally on your device using Apple's Core Data framework. By using Unsorted, you acknowledge that:

• Your task data is stored only on your device, not on our servers or in the cloud
• You are responsible for backing up your device to preserve your data
• Your data will be included in your device's backup (iCloud Backup or iTunes Backup)
• If you delete the app without backing up your device, your data will be permanently lost
• We are not responsible for data loss due to device failure, accidental deletion, or lack of backups
• Each device stores its own data—tasks on one device will not automatically appear on another device

5. Age Requirements

You must be at least 13 years old to use Unsorted, in compliance with Apple's App Store guidelines and children's privacy laws.

If you're under 18, you must have permission from a parent or guardian to use the App and make purchases.

6. Your Responsibilities

You agree to:

• Provide accurate information if you contact us for support
• Maintain the security of your device and Apple ID
• Use the App in compliance with all applicable laws and regulations
• Not use the App in any way that could harm, disable, or impair our services
• Not attempt to gain unauthorized access to any part of the App

You are solely responsible for your device and backing up your data to prevent loss.

7. Intellectual Property

All rights, title, and interest in Unsorted, including all intellectual property rights, are owned by Studio Ascensus and protected by copyright, trademark, and other intellectual property laws.

This includes:

• The Unsorted name, logo, and branding
• The App's source code, design, and user interface
• All graphics, animations, and visual elements
• Documentation and marketing materials

Your task data belongs to you. We claim no ownership over the tasks, notes, or content you create in Unsorted.

8. Disclaimer of Warranties

Unsorted is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information in the App

We strive to make Unsorted as reliable as possible, but we cannot guarantee that it will always work perfectly or meet all your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, Studio Ascensus and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, tasks, or content
• Loss of profits or revenue
• Device failure, data corruption, or storage issues
• Device compatibility problems
• Interruptions in service or access to the App
• Any damages arising from your use or inability to use Unsorted

Our total liability to you for any claims arising from your use of Unsorted shall not exceed the amount you paid for the App (i.e., $14.99 USD or the equivalent in your currency).

Note: Some jurisdictions don't allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Studio Ascensus and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Unsorted
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or store in the App

11. Updates and Modifications

App Updates

We may release updates, bug fixes, or new features for Unsorted from time to time. These updates may be automatic (if you've enabled automatic updates on your device) or may require manual installation.

While we're not obligated to provide updates, we're committed to improving Unsorted and fixing bugs as they arise.

Changes to These Terms

We may modify these Terms from time to time. If we make significant changes, we'll notify you through:

• App Store update notes
• A notice within the App
• An update to the "Effective date" at the top of this page

Your continued use of Unsorted after changes to these Terms constitutes your acceptance of the updated Terms.

12. Termination

Termination by You

You may stop using Unsorted at any time by deleting the App from your device. This does not entitle you to a refund.

Termination by Us

We reserve the right to suspend or terminate your access to Unsorted if you:

• Violate these Terms
• Use the App in a way that harms us or other users
• Attempt to reverse engineer or compromise the App's security

Effect of Termination

Upon termination, your license to use Unsorted ends immediately. Your task data will remain on your device until you delete the app or restore your device.

13. Third-Party Services

Unsorted does not integrate with any third-party services. All data is stored locally on your device using Apple's Core Data framework, which is part of iOS.

If you use iOS device backups (iCloud Backup or iTunes Backup), your Unsorted data will be included in those backups according to Apple's backup policies:

• Apple iCloud Terms of Service (for iCloud Backups)
• Apple Privacy Policy

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Mexico, without regard to conflict of law principles.

However, we recognize that our users are located worldwide, including in the United States and Canada. If you're located in those jurisdictions, you may also have rights under your local consumer protection laws.

Disputes

If you have a dispute with us, please contact us first at miguel@studioascensus.com to try to resolve it informally.

If we can't resolve the dispute informally, any legal action must be brought in the courts of competent jurisdiction in Mexico, or in your local jurisdiction if required by applicable consumer protection laws.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Studio Ascensus regarding your use of Unsorted and supersede any prior agreements.
