Welcome to Unsorted

These Terms and Conditions ("Terms") govern your use of Unsorted - Visual To Do List (the "App"), developed by Miguel Angel Banda Rodriguez, doing business as Studio Ascensus ("we," "us," or "our"). These Terms reflect the features available in version 2.1.0.

By downloading, installing, or using Unsorted, you agree to these Terms. If you don't agree, please don't use the App.

1. The App

Unsorted - Visual To Do List is a visual task management application for supported iPhone and iPad devices. The App allows you to:

• Create visual tasks represented as growing bubbles
• Organize tasks into color-coded categories
• Use reminders, a home-screen widget, and optional calendar time blocking
• Store task content locally on your device
• Manage tasks without due dates, folders, or ads

Version 2.1.0 does not provide multi-device task sync. Anonymous product-interaction analytics are described in Section 5.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use Unsorted on iOS devices that you own or control, solely for your personal, non-commercial use.

What You Can Do:

• Use Unsorted for personal task management
• Install Unsorted on supported devices associated with your Apple Account, subject to App Store rules and availability
• Store and manage a separate set of tasks locally on each device

What You Cannot Do:

• Sell, rent, lease, or sublicense the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code
• Modify, adapt, translate, or create derivative works of the App
• Use the App for commercial purposes without our written permission
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use automated systems (bots, scrapers) to access the App
• Attempt to circumvent any technical limitations or security measures

3. Pricing and Payment

Free Version

Unsorted is free to download and use without an account. The free tier supports up to 10 active tasks and 20 completed tasks and includes the bubble canvas, standard categories, the home-screen widget, and one daily morning reminder.

Unsorted Pro

You can purchase Unsorted Pro as a one-time, non-consumable in-app purchase. Its current U.S. price is $14.99 USD; the price and currency shown by the App Store at the time of purchase control.

• This is a one-time payment, not a subscription
• Pro unlocks unlimited active and completed tasks, per-task reminders, calendar time blocking, and custom category names, colors, and icons
• The purchase can be restored using the Apple Account that bought it, subject to Apple's services and policies
• All purchases and payment processing are handled by Apple through the App Store

Refunds

Refund requests are handled by Apple under its App Store policies. Nothing in these Terms limits any refund or consumer right that cannot be limited under applicable law.

4. Local Task Storage

Unsorted stores your tasks, notes, categories, and preferences locally on your device. The App and its widget may share this data through an app container on that device. By using Unsorted, you acknowledge that:

• Version 2.1.0 does not upload task content to our servers and does not provide multi-device task sync
• Each device has its own task database; installing or using the App on another device does not make your tasks appear there
• Your task data may be included in a device backup if you enable a backup service; that backup is controlled by you and the backup provider
• If you delete the App without an available backup, your locally stored task data may be permanently lost
• We are not responsible for data loss due to device failure, accidental deletion, or lack of backups

5. Anonymous Analytics

Unsorted uses TelemetryDeck to collect anonymous product-interaction analytics so we can understand feature usage, diagnose problems, and improve the App. Analytics may include onboarding progress, screens viewed, feature and setting interactions, task counts, purchase-flow events, the category and priority selected when a task is created, and how long a task took to complete. The App does not send task titles or notes to TelemetryDeck.

• Analytics are not linked to your identity by Unsorted
• Unsorted does not use analytics to track you across other companies' apps or websites
• Unsorted does not sell analytics or task data
• Unsorted does not display advertising

6. Notifications and Calendar Access

If you enable reminders, Unsorted may request permission to send local notifications. You can change notification permission in your device settings.

If you choose the Pro calendar time-blocking feature, Unsorted will request calendar access and create a calendar event containing the task title, date, time, duration, and an alert. Calendar events are then handled by the calendar accounts and services configured on your device and may sync under those providers' terms and privacy policies. Declining calendar access does not prevent you from using the App's other features.

7. Age Requirements

You must be at least 13 years old to use Unsorted, in compliance with Apple's App Store guidelines and children's privacy laws.

If you're under 18, you must have permission from a parent or guardian to use the App and make purchases.

8. Your Responsibilities

You agree to:

• Provide accurate information if you contact us for support
• Maintain the security of your device and Apple ID
• Use the App in compliance with all applicable laws and regulations
• Not use the App in any way that could harm, disable, or impair our services
• Not attempt to gain unauthorized access to any part of the App

You are responsible for your device, your calendar and notification settings, and maintaining any backups you want to rely on.

9. Intellectual Property

All rights, title, and interest in Unsorted, including all intellectual property rights, are owned by Studio Ascensus and protected by copyright, trademark, and other intellectual property laws.

This includes:

• The Unsorted name, logo, and branding
• The App's source code, design, and user interface
• All graphics, animations, and visual elements
• Documentation and marketing materials

Your task data belongs to you. We claim no ownership over the tasks, notes, or content you create in Unsorted.

10. Disclaimer of Warranties

Unsorted is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information in the App

We strive to make Unsorted as reliable as possible, but we cannot guarantee that it will always work perfectly or meet all your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, Studio Ascensus and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, tasks, or content
• Loss of profits or revenue
• Device failure, data corruption, or storage issues
• Device compatibility problems
• Interruptions in service or access to the App
• Any damages arising from your use or inability to use Unsorted

To the maximum extent permitted by law, our total liability to you for claims arising from your use of Unsorted will not exceed the amount you paid for the App.

Note: Some jurisdictions don't allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Studio Ascensus and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of Unsorted
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or store in the App

13. Updates and Modifications

App Updates

We may release updates, bug fixes, or new features for Unsorted from time to time. These updates may be automatic (if you've enabled automatic updates on your device) or may require manual installation.

While we're not obligated to provide updates, we're committed to improving Unsorted and fixing bugs as they arise.

Changes to These Terms

We may modify these Terms from time to time. If we make significant changes, we'll notify you through:

• App Store update notes
• A notice within the App
• An update to the "Effective date" at the top of this page

Your continued use of Unsorted after changes to these Terms constitutes your acceptance of the updated Terms.

14. Termination

Termination by You

You may stop using Unsorted at any time by deleting the App from your device. This does not entitle you to a refund.

Termination by Us

We reserve the right to suspend or terminate your access to Unsorted if you:

• Violate these Terms
• Use the App in a way that harms us or other users
• Attempt to reverse engineer or compromise the App's security

Effect of Termination

Upon termination, your license to use Unsorted ends immediately. Your task data will remain on your device until you delete the app or restore your device.

15. Third-Party Services

Unsorted relies on services provided by Apple for distribution, in-app purchases, purchase restoration, notifications, calendar access, and any device backup you choose to enable. Anonymous product-interaction analytics are processed through TelemetryDeck. Your use of those services may also be governed by their terms and privacy policies.

Version 2.1.0 does not include a third-party service for multi-device task sync.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Mexico, without regard to conflict of law principles.

However, we recognize that our users are located worldwide, including in the United States and Canada. If you're located in those jurisdictions, you may also have rights under your local consumer protection laws.

Disputes

If you have a dispute with us, please contact us first at miguel@studioascensus.com to try to resolve it informally.

If we can't resolve the dispute informally, any legal action must be brought in the courts of competent jurisdiction in Mexico, or in your local jurisdiction if required by applicable consumer protection laws.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Studio Ascensus regarding your use of Unsorted and supersede any prior agreements.
